Purchase through Polar
Polar Software, Inc. acts as merchant of record and authorised reseller for SMTPReady. You purchase the product from Polar under Polar's Buyer Terms. Swobu Ltd grants and governs your right to use SMTPReady under these Terms. Polar handles payment processing, applicable transaction taxes, receipts, refunds and chargebacks for the transaction.
Licence grant
A completed purchase grants you a non-exclusive perpetual licence to use SMTPReady for your own or your organisation's internal purposes, subject to these Terms. One licence permits one active Windows installation at a time. You may move the licence by deactivating the previous installation before activating the replacement. The software and all intellectual-property rights in it remain owned by Swobu Ltd and its licensors; the purchase does not transfer ownership of the software.
What perpetual means
“Perpetual” means the paid licence does not expire solely because time passes and does not require a recurring SMTPReady subscription fee. It does not promise perpetual support, updates, new features, or compatibility with future versions of Windows, Microsoft 365 or other third-party services. Future major versions may be offered separately.
Activation and validation
Initial activation requires an internet connection to Polar. SMTPReady periodically validates an activated licence to detect cancellation, refund, revocation, invalidity or expiry. A previously valid, non-expiring activation does not become invalid solely because Polar validation is unavailable. You must not bypass, disable or interfere with licence or activation controls. An invalid, revoked, refunded, cancelled or expired entitlement may be prevented from accepting new submissions.
Support
Email support is available for supported SMTPReady releases for installation, activation/licensing, product configuration and SMTPReady troubleshooting. We do not promise a response time, resolution time, uptime or service level, and support is not 24/7 or on-call. Support does not include administration of your Windows estate, Microsoft 365 tenant, network, firewall, printers, scanners or other third-party systems. We may ask you to update to a supported release or provide diagnostics before troubleshooting further. See Support or email support@smtpready.com.
Refunds
Polar is the seller for checkout transactions and handles refunds. Swobu Ltd does not offer a separate voluntary refund guarantee. Refunds are handled by Polar under its Buyer Terms, applicable law and, where relevant, any discretionary approval Swobu gives through Polar. We do not pay refunds directly for Polar transactions. A full refund, cancellation or reversal of a transaction may revoke the corresponding SMTPReady licence. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.
Third-party services and customer responsibility
SMTPReady depends on systems you control or obtain separately, including Windows, your network and Microsoft 365. Those services are not included in the SMTPReady purchase and remain subject to their own terms, availability and configuration. SMTPReady is independent software and is not affiliated with, endorsed by or supported by Microsoft. You are responsible for configuring and operating your environment lawfully and for maintaining any Microsoft licences, permissions, certificates, credentials, backups and network access it requires.
Use restrictions
You may not resell, sublicense, rent, distribute or make SMTPReady available as a standalone product to another person, share one licence across multiple simultaneously active installations, or bypass licence controls, except to the extent applicable law gives you a right that cannot be excluded. You must not use SMTPReady unlawfully or to interfere with the rights or systems of others.
Product availability and warranties
We aim to provide software that performs as described for supported configurations, but software and third-party services can fail or change. To the maximum extent permitted by law, we do not guarantee that SMTPReady will be uninterrupted, error-free or compatible with every device, environment or future third-party change. This section does not exclude any warranty or remedy that applicable law makes mandatory.
Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence where applicable law prohibits exclusion.
If you acquire SMTPReady wholly or mainly for your trade, business, craft or profession, then, to the maximum extent permitted by law, Swobu Ltd is not liable for indirect or consequential loss, or for loss of profit, revenue, business or anticipated savings, and Swobu Ltd's total aggregate liability arising out of or in connection with the SMTPReady licence or product is limited to the amount paid for that licence.
If you are a consumer, your mandatory consumer rights and remedies are not affected by these Terms.
Termination
Your perpetual licence continues unless the underlying transaction is cancelled, reversed or fully refunded, or the licence is terminated because of a material breach of these Terms. If a breach can reasonably be remedied, we may require you to remedy it before termination. When a licence ends, you must stop using SMTPReady and uninstall copies covered by that licence. Rights and obligations that by their nature should survive termination continue to apply.
Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer, this choice does not deprive you of mandatory protections or court rights that apply under the law of your country of residence.
Changes
We may update these Terms prospectively, for example to reflect legal, security or product changes. The licence grant applicable to a completed purchase is governed by the terms accepted for that purchase; a later website update does not by itself convert a perpetual paid licence into a subscription or shorten its duration. Changes required by law may apply as the law requires.
